On May 19, 1980, Peter P. Bement, a longtime supporter of restoring aviation to the former Naval Air Station in Magnuson Park at Sand Point in Seattle, loses an appeal to set aside the defeat of an initiative that ended operation of the airport. The Washington State Court of Appeals rejects his request.

Despite the fact that the park officially opened as Warren G. Magnuson Park on May 29, 1977, Bement had continued his legal action in pursuit of an airport. The King County Superior Court dismissed Bement's civil suit in October 1978.

Bement claimed City officials took an advocacy position that swayed voters against the initiative and that they misrepresented the availability of funds. The appeals court upheld the Superior Court's opinion that Bement had delayed unnecessarily by waiting three and one half years after the election before amending his complaint to challenge City actions.
